Commercial debt disputes are one of the most common reasons Irish businesses end up in court — and one of the disputes most suited to mediation. Whether you are owed money by a client, a supplier or a business partner, mediation offers a faster, cheaper, and more reliable route to recovery than litigation.

Why Commercial Debt Disputes End Up in Court

Most commercial debt disputes do not start as legal disputes. They begin as a breakdown in a business relationship — a client claiming work was not completed to standard, a supplier disputing payment terms, or a business partner refusing to honour agreed financial commitments. By the time either party consults a solicitor, both sides are often entrenched and communication has broken down. Mediation intervenes at exactly this point.

How Mediation Resolves Commercial Debt Disputes

A commercial mediator creates a structured, neutral environment in which both parties can present their position and explore what a fair resolution looks like. In debt disputes, this often means the debtor explaining the circumstances behind non-payment and the creditor understanding what realistic recovery looks like. Mediation frequently results in agreed payment plans, partial settlements, or full payment on the day — outcomes that litigation cannot guarantee even after years of proceedings.

Advantages Over Small Claims and Circuit Court

Irish courts are slow. Even in the Circuit Court, commercial debt cases can take 12 to 24 months to reach a hearing. Enforcement after judgment adds further time and cost. Mediation typically resolves a commercial debt dispute within weeks of being engaged, with settlement reached in a single session. The settlement is legally binding and can be enforced as a contract if the terms are not honoured.

Preserving the Business Relationship

For many Irish businesses, the debtor is also a client or a long-term partner. Litigation destroys that relationship permanently and makes a public record of the dispute. Mediation allows both parties to resolve the debt while keeping the door open to an ongoing commercial relationship — something no court can deliver.
